Terms of Service for mynderMail

Agreement to Terms

By downloading, installing, or using mynderMail (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

Description of Service

mynderMail is a mobile application that allows you to quickly send emails to yourself—or other configured recipients—using your Google Account and the Gmail API. The App is designed for convenience and personal productivity, not for emergency communication or mission-critical use.

User Accounts

Google Account:

• You must have a valid Google Account to use the App.
• You are responsible for maintaining the security of your Google Account.
• You are responsible for all activity conducted using your Google Account.
• We are not responsible for unauthorized access to your Google Account caused by factors outside our control.

Account Access (OAuth):

• The App uses Google OAuth to authenticate your account.
• You grant the App permission to send emails on your behalf.
• The App does not read your email, access your inbox, or view your contacts.
• You may revoke this permission at any time in your Google Account settings.
• Revoking access prevents the App from sending emails.

Acceptable Use

You agree to:

• Use the App only for lawful purposes.
• Not use the App to send spam, threats, harassment, or illegal content.
• Not reverse-engineer, modify, or tamper with the App.
• Not use the App in a way that violates Google’s Terms of Service.

Prohibited Uses:

• Sending unsolicited bulk emails (“spam”).
• Sending harmful, abusive, or unlawful content.
• Using the App in violation of local, state, national, or international laws.
• Interfering with or disrupting App functionality.

Email Sending

Gmail API:

• The App uses the Gmail API to send messages directly from your Google Account.
• Your use of Gmail is subject to Google’s Terms of Service: https://policies.google.com/terms
• The App does not intercept, store, or transmit your email content to our servers.

Email Content:

• You are solely responsible for the content of emails sent using the App.
• The App may modify the subject (e.g., by adding quick action labels) or append hints/tips/review nudges to the body. These modifications occur locally on your device before the email is sent.
• We do not monitor, review, or filter email content.
• You agree not to send illegal or harmful content.
• You may not use the App to violate Google’s policies.

Rate Limits:

• Google may impose rate limits on the Gmail API.
• Excessive sending may result in temporary restrictions from Google.
• We are not responsible for Gmail API rate limits or errors.

Crash Reporting

Crash reporting is optional and off by default. If you enable crash reporting, technical crash data may be collected by Sentry (a third-party crash reporting provider). This data may include device type, OS version, app version, and diagnostic information.

• Sentry does not receive your email content or messages. Crash data is technical in nature and does not include message content, subject lines, or any information you type in the App.

Data and Privacy

All data used by the App—such as drafts, history, preferences, and queued messages—is stored locally on your device. We do not collect, store, or transmit personal data to our servers.

Data Loss:

• The App does not provide built-in backup functionality.
• We are not responsible for loss of data stored on your device.
• Uninstalling the App permanently deletes all locally stored data.
• Any local data stored by the App may be lost if your device fails or the App is uninstalled.

Intellectual Property

App Ownership:

• The App and its code, design, and branding are owned by the developer.
• You are granted a non-exclusive, limited license to use the App.
• You may not copy, modify, distribute, or create derivative works without permission.

Your Content:

• You retain ownership of all email content you compose or send.
• The App processes your content locally on your device solely to prepare and send emails.
• Your content is processed locally on your device. We do not store or access your content on our servers, and it is transmitted only to Google’s Gmail API when you choose to send an email.

Disclaimers

No Warranty:

• The App is provided “as is” without warranties of any kind to the fullest extent permitted by applicable law.
• We do not guarantee uninterrupted or error-free operation.
• You use the App at your own risk.

Not for Emergency Use:

• The App must not be used for emergency communication or high-risk situations.

Third-Party Services:

• The App depends on third-party services such as Google’s Gmail API and (optionally) Sentry.
• We are not responsible for the availability or performance of these services.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

Indemnification

You agree to indemnify and hold harmless the developer from any claims or liabilities resulting from your misuse of the App or violation of these Terms.

Modifications to the App

We may modify, update, suspend, or discontinue the App or any of its features at any time without notice.

Termination

By You:

• You may stop using the App at any time.
• Uninstalling the App immediately terminates your use.

By Us:

• We may suspend or terminate access to the App at our discretion, including for violations of these Terms or misuse of the App.
• We may discontinue the App entirely.

Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles.

Severability
